Ease Web Development provides professional web design and development, search engine optimization (SEO), Google Ads management, local SEO, social media marketing, e-commerce solutions, website maintenance, and related digital services. Specific deliverables, timelines, and pricing for each project are outlined in individual project proposals or contracts.
3. Client Responsibilities
To ensure successful project delivery, clients agree to provide all necessary content, images, logos, and brand assets in a timely manner; respond to requests for feedback and approvals within reasonable timeframes; provide accurate business information for use in the project; and designate a primary point of contact for project communications. Delays in fulfilling these responsibilities may impact project timelines.
4. Payment Terms
A deposit is required before work begins on any project, as specified in the project proposal. Remaining payments are structured around project milestones agreed upon in advance. We offer flexible payment plans for qualifying projects to help accommodate your budget. Invoices are due within 15 days of issuance unless otherwise agreed. Late payments may incur a fee of 1.5% per month on the outstanding balance. We reserve the right to pause work on any project with an overdue balance.
5. Intellectual Property
Upon receipt of full payment, the client owns all rights to the completed website, its custom design, and any original content created specifically for the project. We retain the right to display the completed project in our portfolio and marketing materials unless the client requests otherwise in writing. Any pre-existing frameworks, libraries, or tools used in the project remain the property of their respective owners.
6. Project Timeline
All project timelines provided are estimates and not guarantees. While we make every effort to deliver on schedule, timelines may be affected by delays in client feedback or content delivery, scope changes or additional feature requests, technical challenges discovered during development, and third-party dependencies outside our control. We will communicate proactively if any timeline adjustments are necessary.
7. Revisions and Scope Changes
Each project includes a defined number of revision rounds as specified in the project proposal. Revisions refer to modifications within the original project scope. Requests that fall outside the agreed scope, such as new features, additional pages, or significant design changes, will be treated as change orders and may require additional time and cost. We will provide a written estimate for any scope change before proceeding.
8. Hosting and Maintenance
Website hosting and ongoing maintenance are separate from design and development services unless explicitly bundled in a proposal. After project handoff, the client is responsible for hosting fees, domain renewals, software updates, and website security unless enrolled in one of our maintenance plans. We offer monthly maintenance packages to keep your website secure, updated, and performing optimally.
9. Limitation of Liability
To the maximum extent permitted by law, Ease Web Development shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services. Our total liability for any claim related to our services shall not exceed the total amount paid by the client for the specific project in question.
10. Disclaimer of Warranties
THIS WEBSITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. EASE WEB DEVELOPMENT MAKES NO WARRANTY THAT THE WEBSITE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. YOUR USE OF THIS WEBSITE IS AT YOUR OWN RISK.
Client deliverables (completed websites and related work products) are warranted only as described in the applicable project proposal or contract. This disclaimer applies solely to the easewebdev.com informational website.
11. Termination
Either party may terminate a project engagement with 30 days' written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Any deposits paid for work not yet performed may be refundable on a prorated basis at our discretion. We will provide all completed deliverables and project files upon receipt of final payment.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these Terms or our services shall be resolved in the courts of Ector County, Texas.
